Regrettably, Bailey Bernstein was facing felony charges of criminal vehicular injury and leaving the scene of the injury crash.
Hit-and-Run Accident Investigations
In numerous hit-and-run incidents, drivers erroneously believe that they can evade responsibility and evade accountability by leaving the accident scene. However, it is vital to stress that leaving the scene of an accident is a criminal act.
Statistics reveal a concerning trend, indicating that more than one hit-and-run accident transpires every minute on U.S. roads. Reasons for fleeing the scene range from intoxication, driving without a valid license, to evading arrest.
To address such tragic circumstances, it becomes imperative to undertake an independent investigation promptly, guided by an experienced attorney who specializes in hit-and-run accidents. Such investigations are critical to safeguard the rights of the victim’s family and to pursue justice.
Candice Bond, an accomplished hit-and-run accident attorney, emphasized the significance of conducting a thorough examination of road conditions, signage visibility, and road lighting, all of which could be potential contributing factors that may be pertinent in cases like these. She added, “These procedures are necessary for helping someone who has lost a loved one at the hands of a hit-and-run driver receive the justice and monetary compensation that they deserve.”
Wrongful Death Claims
Pending the results of the investigation, the family of Bailey Bernstein may have the right to file a wrongful death claim. Such claims typically cover medical and funeral expenses, the loss of love and companionship, pain and suffering, and emotional trauma.

Stefano Formica, Of Counsel with Bond Legal, explained that an incident is regarded as a wrongful death when a wrongful or negligent act leads to a person’s death. When fatalities result from unsafe, aggressive, or distracted driving, speeding, hit-and-run incidents, or driving under the influence, family members are often left with the option to pursue civil action against the responsible motorist.
